Insurance
The insurance available to protect the professional
against his legal liability for a breach of professional
duty is “Professional Indemnity” (PI). A typical PI policy
will provide indemnity “…against losses arising by reason of
any neglect, error or omission”.
It is of course
important to remember that the professional may not have
breached his duty of care but still requires cover for the
defence of any such claims. PI not only covers defence
costs, but it would also pay for any damages and claimants’
costs should they be awarded against the insured
professional.
